The accordion developer team and the Pokecut application (referred to as “the Application”, “we”, “our”, or “us”) is dedicated to respecting the privacy of our users (“user”, “your”, or “you”). This Privacy Policy outlines how we collect, use, disclose, and protect your information when you access our mobile application. We are committed to ensuring that any personal data we process is securely stored and handled appropriately. We encourage you to read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION.
We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.
This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, including any in-game virtual items, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.
1. COLLECTION OF INFORMATION
We may collect information about you in a variety of ways. The information we may collect via the Application depends on the content and materials you use, and includes:
1.1 Personal Data
Demographic and other personally identifiable information (such as your name and email address) that you voluntarily give to us when choosing to participate in various activities related to the Application. Personal information is collected for communicative and investigative purposes as well, to inform you or to prevent you from engaging in actions regarding unauthorized use of the Application. If personal information is to be used for purposes not mentioned above, we will have to acquire your prior consent.
1.2 Non-personal Information
We may collect information about you which can include: usage information, device information, website information, IP addresses, ads you see, ads you click on and interact with, preferences, and information collected by cookies and other technologies such as web beacons and pixels.
1.3 Camera/Photo Album:
Webcam (camera) and photo album permissions (storage space) are sensitive permissions that we will only use with your express authorization when you use the App for photo editing, branding toolboxes and other functions, and you can withdraw your authorization at any time. We will never turn on the camera without authorization, read album information without authorization to steal your privacy, read your picture content or collect your daily chatting conversations, and we will never use such illegal means to push information and advertisements.
1.4 Metadata
We may collect metadata associated with User Content. Metadata typically consists of how, when, where and by whom a piece of User Content was collected and how that content has been formatted. Metadata of the photos or videos will be used to provide and improve features such as Eye-Points Recognition, Facial Detection, Region Segmentation, content Tags and other customized features derived out of the combination of the above-mentioned features.
1.5 To enable you to use the functions of this application smoothly:
Image and video processing apps often need to use deep learning technology. This app has currently developed or may develop apps that use deep learning related technologies in the future. Since the deep learning technology used in these functions requires a high-performance server to process, you need to upload Pictures or videos are sent to the server for processing. These functions include but are not limited to: AI Background /Retouch/Quality Enhancement, etc. when using this App. When using these features, the app will ask for your permission if it needs to access your device's photo library.
1.5.1 How do we handle personal pictures and videos uploaded to the server: the uploading and processing of this information is necessary to provide these functions, but we will follow the legal requirements and take strict measures for the transmission and storage of your such information Encryption measures to keep your information safe.
1.5.2 The use of such information is limited to providing you with these functional services. After the service is completed, the above information will be automatically deleted by the system and will not be retained. These images are automatically deleted from our servers after 24 hours. Images generated by the app from your uploaded images are automatically deleted from our servers after 15 days. The technology implemented in the application does not allow for unique identification or authentication of individual users.
1.5.3 For the training and improvement of deep learning-related functions, we all use public compliance data sets, or specially purchased legal data sets, and the pictures/videos uploaded by users will not be used for any purposes other than the user functions themselves. Includes training or improvement that will not be used for function.
1.5.4 You guarantee that you have the corresponding legal rights to the uploaded content or have obtained legal authorization from others and have the right to use the above functions. Otherwise, all the consequences and losses caused will be borne by you.
1.5.5 We will not share any information related to 1.5 with any company, organization or individual, except in the following cases: - Sharing with explicit consent: After obtaining your explicit consent, we will share your personal information with other parties. - Sharing under statutory conditions: We may share your personal information externally in accordance with laws and regulations, the need to resolve litigation disputes, and in accordance with the mandatory requirements of local laws. -To the extent required or permitted by law, it is necessary to provide your personal information to a third party in order to protect the interests, property or safety of the Concrete, its users or the public from damage.
1.6 To improve our Apps and quality (for example, by conducting statistical analysis)
In order to ensure the quality of service and improve our applications, we will use Google Firebase or Flurry SDK to collect, analyze, correct faults and errors, illegal use or abuse of applications, and we will collect statistical data on user usage functions, which will not be tracked Individual users, but based on aggregate statistics for all users.
1.7 To process and respond to customer support communications.
In order to help users deal with problems encountered during use, we will collect the identity information and contact information (such as name, email address) you provide to us, as well as the content of your communication or request. We only use this data for user support and if the case is closed we will delete it within 1 year.
1.8 To analyze your usage information, including your preferences, interests and behaviors when you use our products.
We will conduct surveys, statistical analysis or other research activities to improve our products and services, maintain, optimize, and develop new features.
We will advertise our products and services towards more creators like you and reach out to inactive users with our ads. So we will measure the effectiveness of our campaigns and make our advertising more relevant.
These data include your identifiers and Internet and network activity information (such as IDFA or AAID, and IP address), information about your interactions with the app, and other related information about your usage of the app.
IDFA (on iPhone or iPad) and AAID (on Android devices) are unique device identifiers provided by the operating system of your device, that allow advertisers to track and identify a user for advertising purposes. To disable this tracking:
On Android, go to Settings > Privacy > Ads and turn on the “Limit Ad Tracking” button.
2. DATA STORAGE AND PROTECTION
Personal data may be processed by both automated and non-automated means and may be stored at our premises and on our service providers’ servers. We adopt technical and organizational measures designed to prevent the loss, improper use and alteration of your personal data.
Personal data processed for the purposes referred to in Section 1.5 (including personal face images) will be kept for a period not exceeding the one necessary for the said purposes and, Images uploaded to the app to generate AI Drawing are deleted from our servers after 24 hours. Images generated by the app from the images you uploaded are deleted from our servers after 30 days. Please note that the project files and result diagrams uploaded by the user through the “Cloud Storage” function do not belong to the above data category, and will be permanently deleted from the application only after reaching the storage expiration time or deletion by the user manually.
Why we need to store users images data(including users faces) for 24 hours? It is because when users upload images to servers to process, it needs time to process them. In the processing, it may come across some error from model, and have to process again from original images. Besides, users may need to re-create the results, or change device to re-download results. So we will store users images for 24 hours after users download results first time.
Personal data processed for the purposes referred to in Section 1.6, 1.7 and 1.8 will be kept for no more than 2 (two) years from the termination of the agreement.
Except for any legal obligation that sets a longer data retention period, at the end of these periods, the personal data processed will be deleted or anonymized.
3. SHARING OF INFORMATION
We may share your information with third parties outside the Application and in the instances described below:
Ÿ To deliver the services you have requested;
Ÿ We will disclose your information if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use, or to protect the security or integrity of our Application; and/or (c) to exercise or protect the rights, property, or personal safety of the Application, our users or others.
Ÿ We may permit third party online advertising networks to collect information about your use of our website over time so that they could display ads accordingly in relation to your interests. Those business partners will be given limited access to your information that is reasonably necessary to deliver the service. These parties are required to process the information in accordance with our policies.
Ÿ In the event of a change of control on the Application, or any combination of its products, services, assets and/or businesses. Your information such as email addresses, User Content, and other user information related to the Application will likely be among the items transferred in these types of transactions. We will inform you prior to such transactions.
4. SECURITY OF INFORMATION
Precautions are taken by us – including administrative, technical, and physical measures – to safeguard your Personal Information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration and destruction. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that any information disclosed online is vulnerable to interception and misuse by unauthorized parties. We do not guarantee complete security if you provide personal information.
